1. About these terms

These Terms and Conditions (“Terms”) govern your access to and use of the ExportMyEnergy.com platform (“the Platform”), a service provided by Oakwood Energy Brokerage Limitedtd (“Oakwood Energy”, “we”, “us”, or “our”), a company registered in England and Wales (Company No. 10883487) with its registered office at 1 Sandymere Court, Winsford, Cheshire, CW7 2GW. 

These Terms form a legally binding agreement between you and Oakwood Energy. They should be read alongside our Privacy Policy, which explains how we collect and use your personal data, and the Letter of Authority (LoA) which you will be asked to sign separately, and which governs our access to your Export Data from Electralink.. 

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the Platform. Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Terms. 

2. Definitions 

In these Terms, the following words have the meanings set out below:

3. Eligibility and registration 

 3.1. Who can use the Platform 

To use ExportMyEnergy, you must: 

• Be a business entity (including sole trader, partnership, limited company, or LLP) registered in Great Britain; 
• Own or operate one or more electricity generation installations in Great Britain that are connected to the grid and eligible for export; 
• Hold all necessary grid connection agreements, DNO approvals, and applicable certifications (including MCS certification or equivalent) if required for your generation installation(s); 
• Have authority to sign agree the Letter of Authority and to bind your business to these Terms, or are able to provide us with the details of somebody who can; anfd 
• Have a half-hourly smart meter, or agree to have one installed, at each generation site you wish to register on the Platform 

The Platform is intended for use in Great Britain only. Use from Northern Ireland, the Channel Islands, or overseas is not currently supported. 

 3.2. Creating an account 

You must register for an Account to access most features of the Platform. When registering, you agree to: 

• Provide accurate, current, and complete information 

• Keep your account details up to date 

• Keep your login credentials confidential and not share them with anyone 

• Notify us immediately if you suspect any unauthorised access to your Account 

We reserve the right to refuse registration or suspend an Account at our discretion, including where we have reason to believe information provided is inaccurate or where misuse is suspected. 

You must notify us immediately at support@exportmyenergy.com.uk if you suspect any unauthorised access to your Account. 

4. The Services 

 4.1. What we provide 

Through the Platform, Oakwood Energy provides introductions between You and national energy suppliers who may agree to enter into a power purchase agreement with you. If selected, we may also provide you with market updates and contract expiration reminder notifications. You acknowledge and agree that: 

1. Oakwood Energy acts as your agent solely for the purpose of accessing Energy Data from third-parties Electralink under the LoA 

2. Oakwood Energy is not your agent, adviser, or representative in relation to any PPA negotiation or execution 

3. Oakwood Energy does not provide financial, legal, or commercial advice in relation to any Opportunity or PPA 

 4.2. What we do 

Oakwood Energy operates the Platform as an introducer and data broker. Our role is limited to: 

1. Accessing your Energy Data from Electralink on your behalf, under the authority that you grant to us in the Letter of Authority 

2. Processing and presenting your Energy Data on the Platform to enable Energy Suppliers to assess and make Opportunities available to you 

3. Surfacing Opportunities from Energy Suppliers on the Platform for your review 

4. Facilitating an introduction between you and an Energy Supplier where you indicate interest in an Opportunity 

 4.3. Smart meter access 

In order to provide our services, we require access to your half-hourly smart meter data. You will be asked to provide consent for this access during registration, and authorise our access to ElectraLink’sthird-party Data Transfer Service as your authorised agent on your behalf. Without this consent, we cannot provide core Platform functionality. 

 4.4 Service availability 

We aim to keep the Platform available 24 hours a day, 7 days a week, but we do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We will endeavour to provide advance notice of planned downtime where possible.

5. Opportunities and Energy Data Access 

5.1. Your Letter of Authority 

To use the core features of the Platform, you must sign a Letter of Authority (LoA) appointing Oakwood Energy as your authorised agent to access your Energy Data from Electralink. The LoA is a separate document and will be provided to you during registration. It sets out the specific scope of data access, the duration of the authority granted, and how it may be revoked. 

5.2 How we use your Energy Data 

Under the authority granted by the LoA, we will access your Energy Data from Electralink for the following purposes only: 

• To display your generation, consumption, and export amounts for you to access within your account performance on your Platform dashboard 
• To share relevant Energy Data with Energy Suppliers on the Platform to enable them to assess your site and formulate Opportunities 
• To verify your generation and export profile for the purposes of facilitating introductions to Energy Suppliers 
• To maintain records as required by applicable law and regulation 

We will not sell your Energy Data to third parties, nor use it for any purpose not described in these Terms or the LoA without your prior written consent. 

5.3. Revoking your Letter of Authority 

You may revoke the LoA at any time by giving us written notice at support@exportmyenergy.co.ukm. Revocation will take effect within 5 business days of receipt of your notice. Please note that revocation of the LoA will prevent us from accessing your Energy Data and providing our Services, and will therefore result in our termination of these Terms. 

5.4. PPA Opportunities 

We are not responsible and cannot accept any liability for rates, which will be agreed between you and the relevant Energy Supplier. Oakwood Energy is not a party to any PPA. We do not negotiate, guarantee, or underwrite PPA terms on your behalf. We do not handle, hold, process, or transmit any payments between you and an Energy Supplier. Any PPA you enter into is a direct contract between you and the relevant Energy Supplier only. 

5.5. Accuracy and disputes 

We take reasonable steps to ensure Export Dataany third party data is accurate but make no commitment as to the accuracy of any data uploaded to the Platform.  

5.6. How Opportunities are surfaced 

Energy Suppliers registered on the Platform may, at their sole discretion, make Opportunities available to Users whose Energy Data meets their criteria. [Where an Opportunity is available to you, it will be displayed on your Platform dashboard showing the indicative rate and any key terms offered by the Energy Supplier.] 

5.7. Indicative rates 

Rates displayed on the Platform are set solely by the Energy Supplier and are indicative only. They do not constitute a binding offer and are subject to change at the Energy Supplier’s discretion prior to execution of a PPA. Oakwood Energy has no control over, and makes no representation regarding, the rates offered by Energy Suppliers. 

5.8. Expressing interest 

Where you indicate interest in an Opportunity through the Platform, Oakwood Energy will facilitate an introduction bythe execution of a PPA by sharing your relevant contact details and Energy Data profile with the relevant Energy Supplier. Following that introduction, all further negotiation, due diligence, and execution of any PPA takes place directly between you and the Energy Supplier, outside of the Platform. 

5.9. No obligation 

You are under no obligation to pursue any Opportunity surfaced on the Platform. Equally, an Energy Supplier is under no obligation to make an Opportunity available to you or to proceed with a PPA following an introduction. Oakwood Energy accepts no liability for any failure by an Energy Supplier to complete a transaction. 

6. Your obligations 

In using the Platform, you agree that you will: 

• Ensure all information provided to us and to Energy Suppliers (including generation capacity, site details, and export history) is accurate, complete, and not misleading 

• Maintain your generation installation(s) in good working order and in compliance with all applicable laws, regulations, and grid connection requirements 

• Notify us promptly of any material change to your generation site, metering arrangements, or business that may affect your Energy Data or eligibility 

• Not attempt to manipulate, falsify, or interfere with your Energy Data or metering equipment 

• Not use the Platform to approach or contact Energy Suppliers outside the introduction process provided by the Platform in a manner designed to circumvent Oakwood Energy’s commercial arrangements 

• Not use the Platform for any unlawful purpose or in breach of these Terms 

• Not attempt to gain unauthorised access to any part of the Platform or any other User’s Account 

• Not use automated tools, bots, or scripts to access the Platform without our prior written consent.

7. Intellectual property 

All intellectual property rights in the Platform, including its software, design, content, trademarks, and documentation, are owned by or licensed to Oakwood Energy. Nothing in these Terms transfers any intellectual property rights to you. 

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own business purposes solely in accordance with these Terms. You must not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Platform, or seek to use Artificial Intelligence to do so, without our prior written consent. 

retain ownership of your Energy Data. The licence you grant us under the LoA to access and use that data is limited to the purposes set out in Clause 5.2 above..  

8. Limitation of liability 

8.1. Scope of our liability 

Oakwood Energy’s liability to you under these Terms is limited to the proper provision of the Platform as an introducer and data broker service. We are not liable for any matter arising from or relating to any PPA or commercial arrangement between you and an Energy Supplier. 

8.2. What we are not liable for 

To the fullest extent permitted by the Unfair Contract Terms Act 1977 and other applicable law, Oakwood Energy shall not be liable for: 

1. Any loss of revenue, profit, anticipated savings, or business opportunity arising from your use of the Platform; 

2. Any failure by an Energy Supplier to honour, complete, or perform any Opportunity or PPA; 

3. Any inaccuracy in Energy Data caused by third-party metering infrastructure, third-party Electralink systems, or network faults; 

4. Any indirect, consequential, or special loss or damage; or 

5. Loss or damage arising from Platform unavailability due to maintenance, technical failure, or circumstances outside our reasonable control. 

8.3. Cap on liability 

Our total aggregate liability to you under or in connection with these Terms (whether in contract, tort, or otherwise) shall not exceed £500. 

8.4. What this does not exclude 

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded under applicable law. 

9. Warranties and disclaimers 

We warrant that we will provide the Services with reasonable care and skill. We do not warrant that: 

• The Platform will be error-free or uninterrupted at all times; 

• Energy Data will always be available in real-time or free from issues, defects or outages caused by third-party infrastructure;  

•  Any particular volume or value of Opportunities will be made available to you;  

• Any Opportunity surfaced on the Platform will result in an executed PPA; or/and 

• The Platform will be compatible with all devices or operating systems 

The Platform and its analytics tools are provided for informational purposes. Any projections, forecasts, or recommendations displayed are indicative only and should not be relied upon as financial or engineering advice. 

10. Termination and suspension 

10.1. Your right to terminate 

You may close your Account and terminate these Terms at any time by notifying us at support@exportmyenergy.co.ukm. Upon termination, your access to the Platform will cease.  

10.2. Our right to suspend or terminate 

We may suspend or terminate your Account immediately, with or without notice, if: 

• You breach any of these Terms 

• We have reason to believe your Account has been compromised or used fraudulently 

• You provide false or misleading information during registration or thereafter 

• We are required to do so by law or regulatory authority 

• We cease to operate the Platform 

• You no longer meet our eligibility criteria as set out in Clause 3.1 

Where we terminate your Account for reasons other than your breach, we will give you 30 days’ notice where practicable. 

10.3. Effect of termination 

On termination: your licence to use the Platform ends; we will retain your data in accordance with our Privacy Policy and applicable law; and any provisions of these Terms that by their nature should survive termination (including Sections 7, 8, 9, and 11) will remain in force. 

11. Governing law and disputes 

These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. 

Before commencing any legal proceedings, we ask that you contact us at support@exportmyenergy.co.uk to try to resolve the matter informally. We will respond within 10 working days. 

12. General 

12.1. Entire agreement 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oakwood Energy in relation to the Platform and supersede all prior representations, agreements, or understandings. 

12.2. Severability 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. 

12.3. Waiver 

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. 

12.4. Assignment 

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor business, provided we notify you and the successor assumes all obligations under these Terms. 

12.5. Third parties 

These Terms do not create any rights enforceable by third parties under the Contracts (Rights of Third Parties) Act 1999, including by any Energy Supplier.
